1. The Rules and Regulations of Kosmopolita Rooms & Apartments (‘Rules and Regulations’) set out the rules for the provision of services, liability and stay on the premises of Kosmopolita Rooms & Apartments, hereinafter referred to as the ‘Hotel’ and are binding on all persons staying therein.

2. The Rules and Regulations are an integral part of the contract, which is concluded by making a reservation, paying an advance payment or the entire amount due for a stay in the Hotel, as well as by signing the registration card. By performing the aforementioned actions, the person performing them confirms that he/she has read the Rules and Regulations and accepts them without reservation.

3. The Hotel provides accommodation services for adults and minors in their custody. Minors may only check in at the Hotel with an adult. It is not possible for a minor to rent a room on their own. Kosmopolita Rooms & Apartments has the right to refuse to check in a minor who is not accompanied by an adult. Minors should be on the Hotel premises under the constant supervision of their legal guardians.

4 The Hotel applies the Standards for the Protection of Minors, specifically to verify the identity of the minor and their relationship with the adult accompanying them at the property (Act of 13 May 2016 on the prevention of the threat of sexual offences and the protection of minors).

5. The Hotel rooms are rented for duration of hotel day. Hotel days starts from check-in time at 2.00 p.m. and ends in check-out time at 11:00 a.m. on the next day. For guests booking directly through website of The Hotel, check-in starts at 1:00 p.m. and check-out ends at 12:00 p.m. the following day.

6. The person renting the hotel room and residing therein, hereinafter referred to as the Hotel Guest, is obliged to check in – the basis for checking in the Guest is the presentation of an identity card or passport and a signed registration card. If the Guest refuses to show the identity card or passport or refuses to sign the registration card, the Hotel may refuse to check in. In such a situation, the Hotel will consider that the Hotel Guest has not cancelled the reservation within the time limit and will apply the relevant provisions of the Rules and Regulations regarding payment.

7. A wish for extending a stay should be reported at the reception no later than at 11:00 AM on the day of the departure. The Hotel agrees to prolong a stay if there is a possibility and vacancies are available.

8. Payment for a stay is charged by the Hotel in advance. The Guests are required to pay for their stay during the check-in procedure.

9. Payment for reservations is processed in line with the terms specified at the time of booking. In case of non-refundable reservation  hotel will charge credit card 100% of total amount. If the Guest wishes to receive a named or company invoice, he/she should send the invoice details together with the VAT number in the comments when making the booking. If no invoice details are provided, the Hotel will automatically issue a receipt without the possibility of converting the receipt into an invoice.

10. In the event of non-cancellation of the booking within the period specified in the booking conditions or in the event of the Guest not arriving at the Hotel on the scheduled date, the Hotel shall charge the Guest for the first hotel day, with the reservation that if the Guest has made a booking without the possibility of cancellation at no cost, the Hotel shall charge the Guest for the entire booked stay. In the event of cancellation of the Guest’s stay during the course of the hotel day, the Hotel shall not refund the fee for the respective hotel day.

11. Smoking is strictly prohibited throughout the Hotel’s premises, including a ban on tobacco, tobacco products, electronic cigarettes, vaporisers and other smoking devices outside designated areas.  In the event of non-compliance with the ban, the Hotel will charge a fine of PLN 500. In any case of a breach of the smoking ban by a Guest set off the fire alarm, resulting in the intervention of the fire brigade, the Hotel will impose a fine on the Guest to cover the costs of the fire brigade intervention. Unjustified activation of the fire alarm will incur a fine of PLN 500 and, in the event of the intervention of the fire brigade, the Guest will be charged with additional costs related to the arrival of the fire brigade.

12. All persons staying in the Hotel are required to respect night quiet time from 10.00 p.m. to 7.00 a.m.

13. The Guest is obliged to report any malfunctions and damages that he/she notices in the room immediately after check-in. Otherwise, the Hotel reserves the right to charge the cost of repair.The Guest will be held responsible for all damages or destructions of the Hotel equipment and technical appliances arising from their fault or the fault of the people visiting them. The Guest should immediately inform the reception staff about any damage right after its occurrence. Hotel is entitled to charge Guest for any damages recorded by the service, also after check-out. Legal guardians shall be held financially responsible for any damage to the Hotel’s furnishings and technical equipment caused by minors over whom they have a duty of care.If the key is lost, the Guest is obliged to pay a fee of 300 PLN.In case of breaking or destroying the key the Guest is obliged to pay a fee in the amount of 50 PLN. In case of booking for one person and using an extra bed located in the room, the Guest is obliged to pay a fee of 50 PLN.

14. In the case of violation of the provisions of these Rules and Regulations, the Hotel may refuse to continue to provide services to a person who violates them. Such person is obliged to promptly comply with the requests of the Hotel staff, pay for services already provided and for caused damage and destruction and for leaving the Hotel area.

15. The Hotel may refuse to accommodate a Guest who, during their previous stay, seriously breached these Rules and Regulations by causing damage to the Hotel or other Guests’ property or otherwise disrupted the peaceful stay of Guests or the operation of the Hotel.

16. Hotels Personnel may enter the room without informing the Guest only to clean the room or change the bedding. It is also allowed to enter the room in case of dangerous situation or when the Guest do not obey the rules and regulations.

17. The Hotel’s responsibility on account of any loss or damage of things brought to the hotel by the Guest is regulated by the articles 846-849 of the Polish Civil Code. Hotel has a right to refuse to store money, securities and all valuables, especially if they pose danger to the safety of the hotel or their value is too great in relation to the hotel’s size or standard or if they require too much space.

18. The Guest has the right to file a complaint in case if they notice weaknesses in the quality of services provided. All complaints are handled by the reception staff within 14 days.

19. All personal belongings left in a room will be sent to an address indicated by the Guest. The Guest covers the shipping costs. If the Hotel does not receive any instruction, in accordance with the provisions of the Polish Civil Code, the Hotel will store the above items at the owner’s expense for a period of one year, after which time the items will become the property of the Hotel. In the event that a Guest cannot be called upon to collect a found object within 2 years from the date of finding it, the object left behind becomes the property of the finder. The Hotel does not store foodstuffs, medicines or other items that may become damaged or out of date.

20.The Hotel as regards the common areas and the entrance to the Hotel is monitored. Only images (no sound) are recorded and stored. Data from video surveillance may only be made available to entities cooperating in the field of ensuring the safety of persons and property and to entities authorised by law. Data recorded by video surveillance cameras is stored for a period not exceeding 30 days from the date of recording, after which time the data is automatically overwritten. The monitoring is carried out in order to ensure the safety of persons and property on the premises of the Hotel – on the basis of the legitimate interests pursued by the controller (Art. 6(1)(f) RODO). 21. Issues related to the processing and protection of personal data are regulated in detail in Kosmopolita Rooms & Apartments’ privacy policy, the content of which is available on the Hotel’s website and at the Hotel’s reception desk.
